Introduction to the User Agreement:
Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store and all the legal effects resulting from your use of the store’s services on the Internet through this electronic platform. The use of the store by any person, whether as a consumer of a service or a store product or otherwise, constitutes acceptance and approval from that person, with full legal capacity under Sharia, regulations, and law, for all the provisions and conditions of this agreement, and confirms your commitment to its rules and what is stated within it. This agreement applies to all types of dealings between the consumer and the store. This agreement becomes valid and effective as soon as you agree to it and begin registering in the store, in accordance with Article Ten of the Saudi Electronic Transactions Law.
Article One – Introduction and Definitions:
The above preamble is considered an integral part of this agreement, and below you will find the meanings and definitions of the main terms used in this agreement:
1- (The Store): This definition includes all forms of the store on the Internet, whether an electronic application, a website, or a physical store.
2- (Consumer): The person engaging in e-commerce in order to obtain products or services offered by the store through its electronic platform.
3- (Agreement): This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article Two – Consumer’s Legal Capacity:
1- The consumer acknowledges that they have full legal capacity under Sharia and law to deal with the store, or that they are at least eighteen years old.
2- The consumer agrees that if they violate this article, they shall bear the consequences of such violation before third parties.
Article Three – Nature of Obligation:
1- The store’s obligation toward consumers is to provide the (service or product).
2- The store may provide additional services such as after-sales services or other related services, depending on the nature and type of the (service or product) requested by the consumer.
Article Four – Usage Regulations:
1- The consumer is obligated to use the store’s electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2- The consumer is obligated, when purchasing a service or product from this store, not to use this service or product in a manner that violates public morals and the applicable regulations in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations:
Once you apply to join this store as a user, you are obligated to disclose specific information and choose a username and confidential password to use when accessing the store’s services. By doing so, you agree to the following:
1- You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify this store of any unauthorized use of your account information or any other breach of your confidential information.
2- The store shall not, under any circumstances, be responsible for any loss that may occur to you directly or indirectly, morally or materially, as a result of disclosing your username or login information.
3- You commit to using your account or membership in the store personally, and you bear full responsibility for it. If someone else uses it, this is considered evidence that you have authorized them to use the store on your behalf.
4- You commit to using the store with seriousness and credibility.
5- You commit to disclosing true, accurate, updated, complete, and lawful information about yourself as required during registration and commit to updating your data when needed.
6- Our store is committed to handling your personal information and contact details with complete confidentiality.
7- If the store finds that you have disclosed false, inaccurate, outdated, incomplete, or illegal information, or contrary to what is stated in the User Agreement, the store has the right to suspend, freeze, or cancel your membership or your store account on the platform, without prejudice to the store’s other legal rights.
8- If there is any failure to comply with the above, the store’s management has the right to suspend or cancel your store or membership or block your access to the store’s services again.
Article Six – Electronic Communication and Official Communication Channels:
1- The parties to this agreement agree that communication takes place through the email registered on the platform.
2- The consumer agrees that all agreements, announcements, statements, and other communications provided electronically are equivalent to their written counterparts and are valid and effective for fulfilling regulatory and legal requirements.
3- The consumer agrees that communication and notification regarding any provisions related to this agreement may be made through general messages sent by the store’s management to all consumers or specific users.
Article Seven – Amendments to the User Agreement and Fees:
1- If any article or clause in this agreement is canceled or becomes unenforceable, such matter does not invalidate the remaining articles, clauses, rules, and provisions in this agreement, which remain effective until further notice from the store’s management.
2- This agreement — which may be amended from time to time depending on circumstances — constitutes the mechanism of work, understanding, and agreement between the (consumer) and the (store).
3- The store may impose fees on some consumers depending on the offers, products, or services they request, or based on state-imposed fees or taxes related to the nature of the product or service.
4- The store reserves the right to add, increase, reduce, or deduct any fees or expenses according to the terms and provisions of the User Agreement, for any consumer regardless of the reason for their registration.
Article Eight – Payment Services for Stores in the Platform:
1- The store provides, through its partners, a payment system that may be fully processed online through the available payment options or through any other method the store may offer from time to time.
2- The store is committed to determining the price of the service or product offered in its store according to the recognized market value.
3- The store is committed to providing invoices, receipts, and collection documents for all amounts and profits generated in its store, and must provide the consumer with an invoice for their purchase.
4- The store is committed to providing the recognized accounting standards in its electronic store, in accordance with this agreement and the related legal, economic, commercial, and regulatory interests.
Article Nine – Intellectual Property:
1- The intellectual property rights of the store are fully owned by the store, whether owned before or after establishing this electronic platform.
2- The consumer must respect the intellectual property rights of the store, including the store’s name, words, logos, and symbols associated with or displayed on the store, as all rights related to the store’s name are fully owned intellectual property rights.
Article Ten – Store Liability:
1- The store commits to conducting its commercial activity through this electronic platform lawfully and in accordance with the regulations in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
2- The store does not bear any claims arising from errors or negligence, whether directly, indirectly, incidentally, or caused by the consumer or a third party such as shipping companies.
3- The (store name) and its affiliates, owners, and representatives commit that the (product or service) is safe, lawful, licensed under the laws and regulations of the Kingdom of Saudi Arabia, and used for legitimate purposes.
Article Eleven – Restriction of Access or Membership:
The store may suspend or cancel the consumer’s membership or restrict their access to the platform’s services at any time, without notice, and for any reason, without limitation.
Article Twelve – Applicable Law or Regulation:
This User Agreement is governed and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and is fully subject to the laws applicable by the authorities in the Kingdom of Saudi Arabia.
Article Thirteen – General Provisions:
If any article or clause in this User Agreement is canceled or becomes unenforceable, such matter does not cancel the validity of the remaining articles and provisions, which shall remain effective until further notice from the store’s management. This User Agreement — which may be amended from time to time depending on circumstances — constitutes the usage agreement and the mechanism of action, understanding, and contract between the store and the consumer. Both parties agree to consider the following:
1- Arabic is the governing language when interpreting this agreement or translating it into another language.
2- All prices displayed for the store’s services or products may be modified from time to time.
3- Promotional or marketing offers placed by the store are temporary, and the store has the right to modify or cancel these offers at any time.
4- The parties to this agreement commit to dealing with each other in accordance with Sharia rules and the laws and regulations related to the nature of dealings between the store and the consumer.
5- This User Agreement may only be canceled by a decision issued by the store’s management.
